TallyDay Terms of Use

Applies to: TallyDay for iOS and iPadOS

1. These Terms and Apple terms

These Terms are an agreement between you and the developer of TallyDay (“we,” “us,” or “our”), not Apple, concerning your access to and use of the app. We are responsible for TallyDay and its content.

If you obtained TallyDay through the Apple App Store, the Apple Standard End User License Agreement, Apple Media Services Terms, and applicable Usage Rules also apply. These Terms supplement those Apple terms. If they conflict, applicable Apple terms and rights that cannot lawfully be excluded control.

If you are not old enough to enter into a binding agreement where you live, use TallyDay only after a parent or guardian has reviewed and accepted these Terms.

2. What TallyDay does

TallyDay is a local-first personal finance-record and journal tool. Features may include:

Recording income, expenses, categories, notes, and multiple account books;
Displaying statistics, budgets, trends, and charts;
Creating journals, collections, photos, videos, and place records;
Configuring reminders, automatic-entry rules, and app lock;
Importing, exporting, sharing, or backing up financial records and journals;
Syncing or backing up data with Apple iCloud when you choose.

TallyDay does not provide a bank account, payment, money transfer, securities trading, credit, or another regulated financial service. It does not provide financial, investment, accounting, tax, insurance, or legal advice.

3. License

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use TallyDay for lawful personal recordkeeping, journaling, and data management on Apple-branded devices you own or control, as permitted by Apple Usage Rules.

Other accounts associated with the purchaser may access TallyDay through Family Sharing, volume purchasing, or other Apple-permitted arrangements.

Except where applicable law or an open-source license permits it, you may not copy, rent, sell, sublicense, redistribute, commercialize, reverse engineer, decompile, disassemble, modify, defeat security measures, remove rights notices, or create derivative works of TallyDay.

4. Your content

You retain ownership of financial records, journals, photos, videos, places, profile information, and other content you create, enter, capture, import, or store through TallyDay.

You are responsible for your content and must ensure that:

You have the rights needed to store, import, export, or share it;
It does not violate another person’s privacy, copyright, trademark, trade secret, or other rights;
It is lawful, contains no malware, and is not used for unlawful activity.

Before using system sharing, export, family account-book import, or an external service, check the recipient, file contents, and service.

5. Acceptable use

You may not use TallyDay to:

Commit unlawful, fraudulent, infringing, harassing, threatening, or harmful acts;
Collect, process, or distribute another person’s private information without authorization;
Store or share photos, videos, text, statements, or location data you have no right to handle;
Interfere with TallyDay, iCloud, Apple services, or another device;
Distribute malicious code or attempt unauthorized access to systems, containers, or data;
Evade purchase, usage, security, export-control, or sanctions restrictions;
Support prohibited weapons development or another prohibited use.

You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as supporting terrorism and are not listed on a U.S. Government prohibited or restricted-party list.

6. VIP, purchases, and subscriptions

TallyDay may offer VIP features through the Apple App Store, including an auto-renewing annual subscription and a one-time lifetime purchase. The purchase screen and Apple confirmation sheet show the actual products, benefits, price, currency, duration, and any trial.

Apple charges payment to your Apple Account; we do not directly process payment-card information.
An auto-renewing subscription continues unless you cancel through Apple at least 24 hours before the current period ends. Apple may charge renewal within 24 hours before the period ends.
Manage or cancel a subscription in iOS Settings under Apple Account and Subscriptions, or through App Store subscription management.
Use Restore Purchases in TallyDay to verify eligible entitlements for the same Apple Account.
Apple handles refunds, billing issues, Family Sharing, and transaction eligibility under its policies. You can request a refund at Apple Report a Problem.
Unless law or Apple policy says otherwise, cancellation normally does not refund a period already started, and access continues until that period ends.

VIP does not include or sell additional iCloud storage. Apple independently provides iCloud capacity and service.

7. Financial and statistical information

Amounts, categories, budgets, trends, charts, statistics, imported results, and automatic entries are for personal recordkeeping and general information only. We do not guarantee they are always accurate, complete, or suitable for a particular purpose.

Verify important figures and consult a qualified professional before making tax, investment, lending, budgeting, or other important decisions.

8. Data, privacy, and permissions

Our handling of data is described in the TallyDay Privacy Policy.

TallyDay stores content and settings on your device by default. Camera, photo, location, notification, and biometric permissions are requested only for the corresponding feature. You may withdraw them in system settings; doing so affects only the dependent feature.

9. iCloud and third-party services

If you enable iCloud sync or backup, Apple provides iCloud, CloudKit, and iCloud Drive under Apple terms and privacy practices. We do not control service availability, sync speed, storage quota, data-center location, or Apple Account status.

TallyDay may open Apple Maps, Amap, Baidu Maps, Tencent Maps, Google Maps, email, or another external service. You must comply with applicable third-party terms. Each provider independently controls its content, accuracy, availability, charges, and data practices.

10. Backup and data loss

You are responsible for keeping appropriate backups of important content. Although TallyDay provides local storage, export, iCloud sync, and backup, we do not guarantee that an operation will always succeed or that data will never be damaged or lost because of device failure, uninstalling, accidental deletion, insufficient storage, Apple Account or iCloud issues, networks, software defects, system upgrades, incompatible formats, or events beyond reasonable control.

Confirm successful export or backup before uninstalling TallyDay, replacing a device, restoring a system, or performing a bulk import.

11. Updates, changes, and availability

We may release updates to change features, fix issues, improve security, or support newer systems and may reasonably add, modify, suspend, or stop a feature.

TallyDay or a feature may be unavailable because of a device, system, region, language, network, Apple service, or third-party service. We do not promise permanent availability or support for every older system or device. We will provide appropriate information where a major change materially affects user rights.

12. Intellectual property

Except for your content and lawfully used third-party materials, TallyDay software, interface, design, text, graphics, icons, trademarks, code, and related materials are owned by us or the applicable rights holder.

If a third party claims that TallyDay or your lawful use infringes intellectual-property rights, we, not Apple, are responsible for investigating, defending, settling, and discharging that claim to the extent required by applicable law.

Apple, App Store, iCloud, CloudKit, StoreKit, Face ID, and related marks are trademarks or service marks of Apple Inc.

13. Maintenance, support, and product claims

We are responsible for maintenance and support to the extent required by applicable law. Apple has no obligation to provide maintenance or support for TallyDay.

We, not Apple, are responsible for addressing claims relating to possession or use of TallyDay, including product liability, legal or regulatory compliance, consumer protection, privacy, and similar claims.

14. Termination

You may stop using and uninstall TallyDay at any time. If you materially breach these Terms, misuse TallyDay, or use it for unlawful activity, we may terminate or restrict the license or relevant features to the extent permitted by law.

Provisions concerning intellectual property, content responsibility, disclaimers, liability, disputes, and provisions that should survive by their nature remain effective.

15. Disclaimer and Apple responsibilities

To the maximum extent permitted by law, TallyDay is provided “as is” and “as available.” We disclaim warranties beyond those required by law, including merchantability, fitness for a particular purpose, accuracy, continuity, non-infringement, no data loss, or error-free operation.

If TallyDay fails to conform to an applicable warranty, you may notify Apple. Where Apple rules apply, Apple may refund the purchase price for TallyDay. Beyond that refund, Apple has no other warranty obligation for TallyDay. We are responsible for other valid claims, losses, liabilities, damages, costs, or expenses caused by a failure to conform to a warranty to the extent required by applicable law.

Nothing in these Terms excludes a statutory consumer right that cannot lawfully be excluded.

16. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, punitive, or consequential losses arising from use of or inability to use TallyDay, including loss of profit, opportunity, goodwill, or data.

Where law does not permit an exclusion or limitation, it does not apply. These Terms do not exclude liability for intentional misconduct, gross negligence, personal injury, or another liability that cannot lawfully be limited.

17. Governing law and disputes

These Terms are governed by the laws applicable where the developer is established without depriving you of mandatory consumer protection in your habitual residence. The parties should first try to resolve a dispute informally; either party may then bring a claim in a court with lawful jurisdiction.

The United Nations Convention on Contracts for the International Sale of Goods does not apply.

18. Changes to these Terms

We may update these Terms for feature, legal, or operational changes and revise the effective date. If a change materially affects your rights, we will provide notice where required. Continued use after the change takes effect means acceptance unless law requires separate consent.

19. Apple as third-party beneficiary

You and we acknowledge that Apple and its subsidiaries are third-party beneficiaries of provisions relating to the Apple platform. When you accept these Terms, Apple may enforce those provisions against you as a third-party beneficiary.

20. General

If a provision is invalid or unenforceable, the remaining provisions remain effective.
Failure to enforce a right immediately is not a waiver.
You may not assign your rights or obligations without our consent unless law provides otherwise.
These Terms, the Privacy Policy, the Apple Standard End User License Agreement, and other applicable Apple terms form the agreement governing your use of TallyDay.
